Welcome to FieldMate. These Terms and Conditions ("Terms") govern your use of the FieldMate website, platform, and related services.

By accessing or using FieldMate, you agree to these Terms. If you do not agree, please do not use the service.

1. Use of Service

FieldMate provides managed customer communication and lead response services designed to help service businesses capture opportunities, respond to customers, and manage conversations.

Services may include:
Missed call text back
Website lead response
Automated follow-up messaging
Appointment coordination
Customer communication workflows

You agree to use FieldMate only for lawful business purposes and in accordance with these Terms.

2. User Responsibilities

You agree that you will:

- Provide accurate business information
- Use the service in compliance with applicable laws and regulations
- Not use FieldMate for spam, abuse, fraud, or illegal activity
- Be responsible for communications sent through your account

You are responsible for how you use FieldMate to communicate with your customers.

3. SMS & Communication Compliance

FieldMate may send text messages on your behalf as part of your customer communication workflows.

You are responsible for ensuring that you have obtained any required customer consent and comply with applicable messaging laws, including SMS marketing and communication requirements.

You are responsible for message content, customer interactions, and ensuring your use of messaging features complies with applicable regulations.

FieldMate is not responsible for violations caused by improper use of messaging features.

4. Automated Responses

FieldMate uses automated systems to assist with customer conversations, lead qualification, and appointment coordination.

Automated responses are designed to assist your business but may not always interpret customer requests perfectly. You remain responsible for reviewing escalated conversations and handling customer matters appropriately.

5. Account Access

You are responsible for maintaining the security of your account information.

You agree:

- Not to share unauthorized access credentials
- To notify FieldMate of suspected unauthorized access
- That activity under your account is your responsibility

6. Service Availability

FieldMate works to provide reliable service but does not guarantee uninterrupted availability.

Service availability may be affected by maintenance, updates, technical issues, or third-party providers.

FieldMate is not responsible for interruptions caused by circumstances outside of our reasonable control.

7. Payments & Subscriptions

Paid subscriptions are billed according to the plan selected at signup.

- Fees are charged on a recurring basis unless cancelled
- Setup fees and subscription payments are non-refundable unless otherwise stated
- Accounts may be suspended for unpaid balances

You are responsible for applicable taxes associated with your subscription.

8. Third-Party Services

FieldMate may connect with third-party services such as phone providers, messaging providers, calendars, and business software platforms.

FieldMate is not responsible for outages, changes, or limitations caused by third-party services.

9. Intellectual Property

All FieldMate branding, content, software, and materials are owned by FieldMate Systems.

You may not:

- Copy, reproduce, or resell the service
- Reverse engineer or attempt to extract source code
- Use FieldMate branding without permission

10. Data & Privacy

Your use of FieldMate is also governed by our Privacy Policy.

You retain ownership of customer information submitted through your account. You grant FieldMate permission to process and store this information only as needed to provide the service.

11. Limitation of Liability

To the maximum extent permitted by law, FieldMate is not responsible for:

- Lost revenue or missed business opportunities
- Failed communications or customer responses
- Indirect or consequential damages

FieldMate is designed to assist your business but does not guarantee specific sales results, booked jobs, or revenue increases.

12. Indemnification

You agree to protect and hold FieldMate harmless from claims resulting from:

- Your use of the service
- Your customer communications
- Violations of applicable laws or regulations

13. Termination

FieldMate may suspend or terminate access if you:

- Violate these Terms
- Misuse the service
- Engage in unlawful activity

You may cancel your subscription at any time according to your billing terms.

14. Changes to Terms

FieldMate may update these Terms from time to time.

Continued use of the service after changes means you accept the updated Terms.

15. Governing Law

These Terms are governed by the laws of Manitoba, Canada.
